Terms of Service for Coffee Leads

These Terms of Service ("Terms") govern your access to and use of Coffee Leads ("the Service"), operated by Pierre Rondeau, micro-entrepreneur registered in France (SIREN: 850976713), located at 5 Chemin Du Vieux Clos, 44340 Bouguenais, France.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Coffee Leads is a B2B lead generation platform that delivers 10 qualified leads to your dashboard every morning at 7:00 AM (CET). The Service uses artificial intelligence to detect buying signals from publicly available LinkedIn data, score lead relevance, and generate personalized outreach hooks.

2. Eligibility

The Service is intended for business professionals (B2B). You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements.

3. Account Registration

3.1 You may create an account using Google OAuth or email/password registration.
3.2 You are responsible for maintaining the confidentiality of your account credentials.
3.3 You are responsible for all activity that occurs under your account.
3.4 You must provide accurate and complete information during registration and onboarding.
3.5 One account per person. Shared accounts are not permitted.

4. Free Trial

4.1 New users receive a 7-day free trial with full access to the Service.
4.2 No payment information is required to start the trial.
4.3 At the end of the trial period, access to new leads is suspended until you subscribe.
4.4 Your data (ratings, notes, preferences, Barista Brain progress) is retained after the trial ends.
4.5 The free trial is available once per user. Creating multiple accounts to obtain additional trials is prohibited.

5. Subscription and Billing

5.1 The Service is offered as a monthly subscription at 99 EUR/month (tax inclusive, micro-entrepreneur regime).
5.2 Payment is processed securely by Stripe. We do not store your payment card details.
5.3 Subscriptions renew automatically each month on the anniversary of your initial payment.
5.4 You can cancel your subscription at any time through the billing portal accessible from your Settings page.
5.5 Upon cancellation, you retain access until the end of your current billing period.
5.6 No partial refunds are provided for unused portions of a billing period.

6. Right of Withdrawal (EU Consumers)

6.1 Under EU consumer protection law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of your subscription purchase.
6.2 By using the Service during the withdrawal period, you acknowledge that you have requested immediate access to the digital service.
6.3 If you have used the Service during the withdrawal period, a proportional amount may be charged for the service received.

7. Refund Policy

7.1 If you are unsatisfied with the Service, you may request a full refund within 14 days of your first payment, provided you have not accessed more than 3 days of leads.
7.2 Beyond the 14-day window, refunds are granted on a case-by-case basis at our discretion.

8. Acceptable Use

You agree NOT to:
8.1 Use the Service for spam, unsolicited bulk messaging, or any activity that violates applicable anti-spam laws.
8.2 Scrape, crawl, or automatically extract data from the Service beyond what is provided through official features (dashboard, API, CSV export).
8.3 Resell, redistribute, or sublicense access to the Service or the leads delivered.
8.4 Attempt to reverse-engineer the lead scoring algorithm or signal detection system.
8.5 Create multiple accounts to circumvent usage limits, trial restrictions, or billing.
8.6 Use the Service in any manner that violates applicable laws or regulations.
8.7 Share your API key with third parties.

9. LinkedIn Data and Your Responsibilities

9.1 The Service collects and analyzes publicly available information from LinkedIn to generate leads. We do not access private messages, connections lists, or restricted profile data.
9.2 You are solely responsible for your outreach activities. The leads and hooks provided are suggestions; you must ensure your outreach complies with applicable laws (GDPR, CAN-SPAM, etc.) and LinkedIn's terms of use.
9.3 We do not guarantee that contacting a lead will result in a business outcome. Lead quality depends on many factors beyond our control.
9.4 We are not affiliated with, endorsed by, or sponsored by LinkedIn Corporation.

10. AI-Generated Content

10.1 The Service uses AI (Anthropic Claude) to generate lead scores, relevance assessments, and outreach hooks.
10.2 AI-generated content is provided as a starting point. You should review and customize hooks before using them in outreach.
10.3 We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
10.4 You are responsible for the content of any messages you send using hooks generated by the Service.

11. API Access

11.1 The Service provides an API for programmatic access to your leads and statistics.
11.2 API usage is subject to rate limiting (100 requests per hour per API key).
11.3 Your API key is personal and must not be shared or published.
11.4 We reserve the right to revoke API access in case of abuse or violation of these Terms.

12. Intellectual Property

12.1 The Service, including its design, code, algorithms, signal library, and branding, is the exclusive property of Pierre Rondeau.
12.2 You retain ownership of any notes, ratings, and custom content you create within the Service.
12.3 You are granted a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during your active subscription.

13. Service Availability

13.1 We aim to provide the Service 24/7 but do not guarantee uninterrupted availability.
13.2 We may perform maintenance or updates that temporarily affect access. We will make reasonable efforts to minimize disruption.
13.3 We are not liable for losses resulting from service interruptions, whether planned or unplanned.
13.4 Lead delivery depends on the availability of third-party data sources (LinkedIn, etc.). We cannot guarantee that 10 leads will be available every day for every user profile.

14. Limitation of Liability

14.1 To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service is limited to the amount you have paid us in the 3 months preceding the claim.
14.2 We are not liable for:
  - Lost revenue or business opportunities resulting from lead outreach
  - Actions taken by third parties you contact through the Service
  - Inaccuracies in publicly available LinkedIn data
  - Consequences of AI-generated content you choose to use
  - Service interruptions caused by factors beyond our control

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service in violation of these Terms
- Your outreach activities using leads or hooks from the Service
- Your violation of any applicable law or third-party rights

16. Termination

16.1 You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.
16.2 We may suspend or terminate your account if you violate these Terms, with or without prior notice.
16.3 Upon termination, your access to the Service ceases. Your data will be handled according to our Privacy Policy.

17. Modifications to the Terms

17.1 We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 15 days before taking effect.
17.2 Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
17.3 If you disagree with the changes, you may cancel your subscription before the new Terms take effect.

18. Governing Law and Disputes

18.1 These Terms are governed by the laws of France.
18.2 In case of a dispute, we will first attempt to resolve it amicably. You may contact us at hello@prometh-ai.com.
18.3 If no resolution is reached, the dispute will be submitted to the competent courts of Nantes, France.
18.4 EU consumers may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Force Majeure

We are not liable for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, war, government actions, internet outages, or third-party service disruptions.
